Oktopus Privacy Policy

This Privacy Policy (“Policy”) governs your use of the Oktopus software application, including the standalone application and AUv3 plug-in (collectively, the “Application”), developed and provided by Tatreal or Vyacheslav Anatolevich Koristov (“we,” “us,” or “our”). This Policy explains our practices regarding the collection, processing, storage, and sharing of information and data when you use the Application.
1. Overview and Core Principles
The Application is a creative audio instrument designed to operate with a privacy-first architecture. All audio synthesis, MIDI processing, preset management, sample handling, and media processing take place exclusively on your local device.
We do not collect your personal data, we do not track your activity, we do not employ advertising or behavioral profiling services, and we do not transmit your recordings, media files, performances, or created content to our servers or any third parties.
2. Information We Do Not Collect
We do not collect, harvest, monetize, or transmit any of your personal data through the Application. Specifically:
- Personal Information: We do not collect your name, email address, postal address, telephone number, device identifiers (such as IDFA or vendor IDs), network addresses (IP addresses), or physical location data.
- Usage and Behavioral Analytics: We do not integrate third-party analytics frameworks, crash-logging tools that collect telemetry, or behavioral tracking SDKs.
- Your Creative Content: We do not collect, monitor, or access your microphone recordings, imported audio files, imported photos, imported videos, custom waveforms, presets, MIDI sequences, or musical compositions.
3. Device Permissions and On-Device Processing
The Application may request access to certain device hardware and system features to provide specific creative capabilities. All data accessed through these permissions is processed strictly on your local device.
Microphone Access
The Application may request permission to access your device’s microphone to allow you to record audio, capture real-time audio input, and sample acoustic material directly into the Application.
Microphone input is processed entirely in real-time in local device memory. We never transmit, store, intercept, or upload your microphone audio to remote servers. Audio recorded via the microphone remains stored exclusively on your device unless you voluntarily elect to export, share, or transfer that audio outside the Application.
Photos, Videos, and Media Sampling
The Application includes features for visual media sampling, allowing you to import photos and videos from your device’s photo library or file storage. These visual assets are used to extract audio streams, perform image-to-audio spectral sonification, synthesize custom waveforms, and provide synchronized video playback alongside musical performance.
All photo and video processing is conducted strictly on your local device. When you utilize the system photo or file picker, the Application accesses only the specific photos or videos you affirmatively select. We do not inspect your broader photo library, nor do we collect, upload, store, or transmit your photos, videos, or derived visual data to external servers.
File Storage and Imported Media
When you import audio files, images, videos, or preset files into the Application, those files are read and processed locally on your device for playback and sound generation. We do not receive, copy, or upload your imported files to our systems.
MIDI and Bluetooth Connectivity
The Application supports CoreMIDI, MIDI 2.0, MPE (MIDI Polyphonic Expression), and Bluetooth Low Energy (BLE) MIDI to enable communication with external musical instruments and controllers. This connectivity operates strictly between your device and your connected hardware. We do not collect, record, or transmit your MIDI performance data or details regarding your connected hardware peripherals.
4. Presets, Exported Content, and Sharing
Local Storage of Your Content
The Application enables you to create, save, import, and export presets, audio samples, and media-linked configurations. Your saved presets may incorporate your custom synthesis parameters, custom waveforms, and references to—or embedded copies of—the audio samples, photos, and videos you have imported. All such presets, assets, and configurations are stored solely on your local device.
Sharing and Transferable Items
We do not automatically share, publish, or synchronize your presets, samples, imported media, or exported audio/video files with any external server or third party.
Your imported photos, videos, and samples remain strictly confidential to you on your device, subject to the following exception:
- Voluntary Preset & Media Export: If you decide to export a preset that references or embeds photos or videos you have imported, or if you export a rendered audio or video file, the resulting transferable file will contain or bundle that content so it can function across compatible systems.
Public Visibility of Your Transferable Files
Any transferable files, exported presets, or media items you create remain entirely private until and unless you affirmatively choose to make them public. If you decide to publish, upload, post, or distribute an exported file or preset (for example, to an online forum, community repository, cloud storage provider, or social media platform), that content becomes publicly accessible solely by virtue of your own voluntary distribution. You maintain full ownership of your creative content and bear sole responsibility for where and with whom you share your exported files.
When you transmit or share an exported file through iOS share extensions, messaging services, cloud storage providers, or third-party platforms, the handling of that shared file is governed exclusively by the terms and privacy policies of the destination service you select.
5. Third-Party Services
The Application contains no third-party advertising networks, affiliate tracking links, or commercial profiling SDKs. When you choose to transfer or share files using operating system sharing sheets, Apple Files, cloud synchronization providers (such as iCloud Drive, Dropbox, or Google Drive), email, or social media, those transfers occur outside the Application and are governed by the respective privacy policies of those third-party providers.
6. Data Retention and Deletion
Because we do not collect or store your personal data or creative content on our servers, we maintain no database of your information. All recordings, imported photos, imported videos, samples, presets, and exported files reside exclusively on your local device storage.
You retain complete control over your data. You may delete any saved presets, imported media, or recordings at any time through the Application’s built-in file management interfaces, through the iOS Files application, or by uninstalling the Application from your device.
7. Children’s Privacy
The Application is a music creation tool that processes all data locally without registration or remote account creation. We do not knowingly collect, solicit, or maintain personal information from children under the age of 13 (or under the applicable age of consent in your jurisdiction).
8. Changes to This Privacy Policy
We may amend or update this Privacy Policy from time to time to reflect modifications to the Application’s features, technological developments, or evolving legal and regulatory requirements. Any updates will be posted with a revised “Last updated” date at the top of this Policy. Your continued use of the Application following the publication of an updated Privacy Policy signifies your acknowledgment of the revised terms.
